A temporary restraining order can be granted the same day the petition is filed. The hearing that decides whether that order becomes permanent is usually scheduled within 20 to 25 days.

Why Choose Schank Family Law for Restraining Orders in Monterey, CA?

Familiarity With Monterey County Courts

Our attorneys regularly appear at the Monterey County Superior Court, and that familiarity with local procedures, hearing schedules, and judicial expectations matters when your case is on a compressed timeline. Derek Austin is a California-certified Family Law Specialist, a distinction held by a small percentage of attorneys in the state. He started his own family law practice in 2010 and merged with Schank Family Law in 2017. He has successfully defended clients in serious domestic violence trials and secured a $22,000 per month temporary spousal support award in a high-conflict case. Our family lawyer in Monterey, CA brings that courtroom and trial experience to every restraining order case we take on.

Both Sides of the Case

Not every firm handles petitioners and respondents, but we represent both. When you’re in danger and need a protective order, we’ll help you file a declaration strong enough to meet the legal standard and pursue every form of relief available under California law. If you have been served with a TRO based on claims you believe are false or exaggerated, we will build a defense that addresses each allegation directly.

Family Code Section 3044 provides that a finding of domestic violence creates a presumption against awarding custody to the parent who committed the abuse. That means a restraining order can reshape child custody proceedings, divorce negotiations, and parenting time for years.

Committed Advocacy and Credentials

Founding Attorney Christian L. Schank has practiced family law in California since 2003. He holds an AV Preeminent rating from Martindale-Hubbell, the highest peer review distinction available for legal ability and ethical standards, and has maintained Lead Counsel Verified status in family law since 2015. Types of Restraining Order Cases We Handle in Monterey

Restraining orders in California are not interchangeable. Which order you need, or need to defend against, depends on your relationship with the other person and the nature of the alleged conduct. We handle every category of restraining order recognized under California law.

Domestic violence restraining orders (DVROs). DVROs are the most common protective orders in family law. They shield someone from a spouse, former partner, co-parent, or close family member who has committed abuse. California defines abuse broadly to include physical harm, threats, stalking, harassment, and conduct that disturbs someone’s peace. We handle both petitions and defenses, and we understand how these orders interact with custody and emergency child protection measures.

Elder abuse restraining orders (EAROs). These protect individuals aged 65 and older, or dependent adults, from physical abuse, neglect, financial exploitation, or abandonment by caregivers or family members. Our attorneys have handled EARO petitions and defenses across multiple California counties.

Civil harassment restraining orders. When the person threatening you is not a close relative or former intimate partner, a civil harassment restraining order is the appropriate legal remedy. These are heard separately from domestic violence matters at the Monterey courthouse.

Emergency protective orders. If law enforcement responds to a domestic violence call, an officer can contact a judge and obtain an emergency protective order on the spot. These last five to seven calendar days and can require the alleged abuser to leave the home. We help clients transition from emergency orders to temporary restraining orders and, if needed, to longer-term DVROs.

Restraining orders involving children. When children are involved, a restraining order can include temporary custody and visitation orders, child support directives, and move-out provisions. These temporary orders can carry over into the broader custody case, making the restraining order hearing itself a Monterey restraining order lawyer’s first opportunity to shape the custody outcome.

California Legal Requirements for Restraining Orders

California’s Domestic Violence Prevention Act governs how protective orders work. Under Family Code Section 6300, a court can issue a restraining order if there is reasonable proof of a past act or acts of abuse. Judges can grant the order based solely on the petitioner’s sworn written statement. No separate corroborating evidence is required, though additional evidence strengthens the case.

TROs can be issued the same day you file. The California Courts self-help guide explains that once a TRO is granted, a hearing date is set approximately 20 to 25 days later. At that hearing, both sides can present evidence, call witnesses, and argue their positions. Once the judge grants a longer-term order, it can last up to five years under Family Code Section 6345.

There is no filing fee for domestic violence restraining orders in California. Sheriff’s deputies will also attempt to serve the papers at no cost. Under Family Code Section 6389, a person subject to a restraining order must relinquish all firearms and ammunition within 48 hours. Federal law reinforces that prohibition, and violations carry criminal penalties. Filing errors, missed deadlines, or incomplete declarations can weaken a case before it reaches a judge. Understanding the full restraining order process from the outset helps prevent those mistakes.

Important Aspects of a Monterey Restraining Order Case

Writing a Strong Declaration

Your written declaration is the single most important document in the initial filing. Judges in Monterey County read these to decide whether a temporary order should issue. Vague statements about feeling unsafe won’t meet the standard. You need specific dates, detailed descriptions of each incident, and context explaining why you fear continued abuse. A Monterey restraining order attorney can help you organize this information so that it meets the legal threshold.

How Restraining Orders Affect Custody

Restraining orders can directly determine the outcome of a custody dispute. Family Code Section 3044 establishes a rebuttable presumption that awarding custody to a parent found to have committed domestic violence is not in the child’s best interest. That presumption applies whether you are the petitioner or the respondent. If you’re petitioning for a DVRO, the custody implications strengthen your position. If you are defending against allegations, an inadequate response could cost you meaningful time with your children. Fathers facing these situations should also understand how restraining orders can affect fathers’ rights in Monterey County courts.

False Allegations and Strategic Filings

Not every restraining order petition is filed in good faith. Some are filed in the middle of a divorce or custody dispute to gain a strategic advantage. When a respondent can demonstrate that the allegations are fabricated, the court has discretion to deny the order. The judge can also weigh the false filing when making future custody decisions. We’ve defended against these allegations in Monterey County and throughout California.

Temporary Orders vs. Permanent Orders

A TRO is only the beginning. It lasts until the hearing date, at which point the judge decides whether to issue a longer-term order. Should the respondent present a compelling defense, the petition can be denied entirely. And if the petitioner fails to appear at the hearing or doesn’t present sufficient evidence, the TRO expires without any permanent order taking its place.

Financial Relief Through Protective Orders

California allows a petitioner in a DVRO case to request temporary spousal support and property control orders at the same time. Under Family Code Section 6324, the court can order the restrained party to pay support and determine temporary possession of shared assets. For someone leaving an abusive relationship, this financial stability can be essential while the broader family law case moves forward.
