When your safety or your children’s safety is at risk, knowing how to obtain legal protection quickly can be life-changing. In California, domestic violence restraining orders provide comprehensive protections designed to keep victims safe while their cases move through the legal system. However, many people don’t fully understand who qualifies for these orders, what constitutes domestic violence under California law, or what protections these orders actually provide.
Who Can Obtain a Domestic Violence Restraining Order?
A domestic violence restraining order is a specific type of protective order that can only be obtained against someone with whom you have a particular type of relationship. This isn’t a restraining order available against just anyone who threatens or harms you. Instead, California law limits domestic violence restraining orders to situations involving domestic relationships.
You may be eligible to file for a domestic violence restraining order if the person you need protection from falls into one of these categories: someone you are currently married to or were previously married to, someone with whom you share children, someone with whom you have or had a dating relationship, someone you live with or have lived with, or family members including parents, children, siblings, grandparents, and even in-laws.
This broad definition ensures that many people in vulnerable situations can access these powerful protections. Whether you’re currently in the relationship or it ended years ago, you may still qualify for a domestic violence restraining order if abuse occurs or threatens to occur.
What Qualifies as Domestic Violence in California?
Many people mistakenly believe domestic violence only refers to physical abuse such as hitting, pushing, or other violent physical contact. While physical abuse certainly qualifies, California’s definition of domestic violence extends much further and encompasses many behaviors designed to control, intimidate, or harm you.
Breaking objects during arguments, throwing things, punching holes in walls, or destroying property can all constitute domestic violence. These actions are often intended to intimidate and control through fear, even when they don’t involve direct physical contact with the victim. Similarly, preventing you from leaving a room or home during an argument qualifies as domestic violence because it restricts your freedom of movement.
California law also recognizes that modern technology creates new avenues for control and abuse. Tracking your location through your phone or vehicle, monitoring your communications, or using technology to surveil you without consent all qualify as domestic violence. Even seemingly minor actions like taking away your cell phone or car keys can be considered domestic violence when done as a means of control.
Financial control represents another form of domestic violence recognized under California law. When someone restricts your access to money, prevents you from working, controls all financial resources, or otherwise uses finances as a means of maintaining power over you, this constitutes domestic violence.
Perhaps most importantly, abuse doesn’t have to be directed at you personally to qualify as domestic violence. Abuse directed toward your children or even your pets can form the basis for a domestic violence restraining order. Any person who uses fear, force, or control tactics against you or those you care about may be subject to a restraining order under California’s broad definition of domestic violence.
What Protections Does a Domestic Violence Restraining Order Provide?
Domestic violence restraining orders offer powerful and immediate protections for victims. Understanding what these orders can accomplish helps you determine whether seeking one is the right choice for your situation.
One of the most significant protections is the immediate removal of the restrained person from your home. Even if they own the home or their name is on the lease, a domestic violence restraining order can require them to leave immediately, allowing you to remain safely in your residence.
The order prohibits all contact between the restrained person and you. This means no in-person contact, no phone calls, no text messages, no emails, no social media contact, and no communication through third parties. The restrained person cannot have someone else contact you on their behalf. This comprehensive no-contact provision creates a protective barrier that helps ensure your safety.
Domestic violence restraining orders also establish a physical distance requirement, typically 100 yards. The restrained person must stay at least 100 yards away from your home, your workplace, and your vehicle. This protective boundary helps ensure you can go about your daily activities without fear of encountering the person who has harmed you.
For those with children, domestic violence restraining orders provide the fastest way to obtain emergency child custody and visitation orders. When a temporary restraining order is granted, it can immediately stop all visitation between the restrained parent and the children until the court hearing occurs. This protection is crucial when you have concerns about your children’s safety.
California law also requires that anyone subject to a domestic violence restraining order immediately surrender all firearms and ammunition. The restrained person must turn over their guns to either the sheriff or a licensed gun dealer. This requirement exists because the presence of firearms dramatically increases the danger in domestic violence situations.
The Timeline: Temporary Orders and Permanent Protection
When you file for a domestic violence restraining order, you’re initially seeking temporary orders. These orders typically last until your court hearing, which is usually scheduled approximately three weeks after you file. In many cases, temporary orders can be granted the same day you file, providing immediate protection while your case is pending.
A judge makes the initial decision about temporary orders based solely on the paperwork you submit. This is why the quality and detail of your application matters tremendously. Your paperwork should include specific information about the domestic violence including dates, times, detailed descriptions of incidents, and any other relevant information that demonstrates why you need immediate protection.
The court can grant your requested temporary orders fully, partially, or deny them entirely until the hearing. Even if your temporary orders are denied, you’ll still have an opportunity at the hearing to present evidence and obtain permanent protection.
At the hearing approximately three weeks later, both you and the restrained person have the opportunity to present evidence. This is a trial where witness testimony, documents, photographs, and other evidence can be presented. The judge will consider all the evidence and determine whether domestic violence has occurred and whether permanent orders are justified.
Just because you received temporary orders doesn’t guarantee you’ll receive permanent orders. The hearing is your opportunity to prove your case, and understanding how to present evidence effectively is crucial. Permanent domestic violence restraining orders can last for years, providing long-term protection when the court determines it’s necessary.
