If you’re going through a divorce in Riverside County, one of the most stressful questions you’ll face is figuring out who gets what when everything is divided. The family home, retirement accounts, investment properties, vehicles, business interests, and everything else you’ve accumulated during your marriage all needs to be sorted out and divided between you and your spouse. California law says that division should be equal, but equal rarely means simple, and achieving a truly fair division requires careful analysis of what you own, what you owe, and how those assets should be characterized under the law.
A Riverside, CA property division lawyer can help you understand exactly what you’re entitled to under California’s community property system and fight to make sure you receive your fair share when the marriage ends. At Schank Family Law, we have handled asset division cases across California for more than two decades, representing clients whose situations range from modest estates to complex holdings involving multiple properties and business interests. Schedule a free consultation to discuss your property division concerns and learn how California law applies to your situation.
Property division requires attorneys who understand not just family law statutes but also the financial complexities that arise when substantial assets need to be valued and divided fairly between two people whose interests no longer align. Founding attorney Christian Schank has been a member of the California State Bar since 2003 and maintains an AV rating from Martindale along with Lead Counsel Verified status for family law matters. He has spent that time developing the expertise necessary to handle everything from straightforward divisions of a family home and retirement accounts to complicated cases involving closely held businesses, multiple real estate holdings, and disputes about what qualifies as community versus separate property.
Christian earned his Juris Doctor from the University of La Verne College of Law and built his practice on the principle that every client deserves representation from an attorney who genuinely understands what’s at stake financially when a marriage ends. When property division cases require business valuations, forensic accounting to identify hidden income, or expert analysis of retirement benefits and pension structures, we coordinate with financial professionals who specialize in divorce-related work and understand exactly what courts need to see in order to make informed decisions about asset division.
Our family lawyer in Riverside, CA offers free initial consultations because we believe you deserve to understand your legal position before making any commitments about representation, and these meetings give us the opportunity to assess your situation and provide honest feedback about what outcomes are realistic.

Every divorce involves different assets, different debts, and different complications that require tailored strategies rather than generic approaches. Our Riverside property division attorneys handle cases involving all types of marital estates.
California follows community property rules that differ significantly from the equitable distribution systems used in most other states. Under Family Code Section 760, property acquired during marriage belongs equally to both spouses regardless of which spouse earned the income or whose name appears on the title.
Separate property stays with the spouse who owns it, including assets owned before marriage, inheritances received by one spouse alone, and gifts given specifically to one spouse rather than to the couple jointly. However, separate property can become complicated when mixed with community property over time, such as when community funds pay down a mortgage on property one spouse owned before the marriage, potentially creating reimbursement claims under Moore/Marsden calculations that can shift significant money between the parties.
The date of separation carries significant weight because it determines when community property accumulation stops. Under Family Code Section 771, earnings after separation become separate property, meaning a few months’ difference in the determined separation date can shift tens of thousands of dollars between spouses in cases involving substantial income.
Both spouses owe fiduciary duties regarding community property management that continue during divorce proceedings even as the relationship deteriorates. Family Code Section 1100 requires each spouse to manage community assets with the care of a trustee, and hiding assets, transferring property without consent, or wasting community funds can result in serious sanctions when the misconduct comes to light.
The California Courts require both parties to exchange comprehensive financial disclosures listing all assets, debts, income, and expenses. Understanding financial disclosure requirements and taking time to prepare financially helps ensure you protect your interests throughout the process.
Property division under California law aims for an equal split of the net community estate, but several factors affect what you actually receive, and recovery can extend beyond simple 50/50 division in certain circumstances where reimbursement claims or misconduct come into play.
Your share of community property. You’re entitled to half the net value of all community assets after subtracting community debts, including your portion of family home equity, retirement accounts, vehicles, bank accounts, and business interests. Accurate valuation is critical because undervaluing an asset by $100,000 costs you $50,000 directly from your share of the marital estate.
Reimbursement claims. If separate property funds paid community debts or improved community assets, that spouse may recover the contribution before remaining property gets divided. Understanding community property rules helps identify these claims before they get overlooked in settlement negotiations.
Remedies for fiduciary breach. Under Family Code Section 1101, a spouse who hid assets or deliberately wasted marital funds faces serious consequences, and courts can award up to 100% of the affected asset to the wronged spouse in cases involving intentional concealment.
Epstein credits. When one spouse pays community debts from separate funds after separation, they may receive credit for those payments when property gets divided at the conclusion of the case.
Spousal support interaction. Support and asset division interact in ways that affect overall outcomes, and courts consider the complete financial picture when structuring divorce settlements because a spouse receiving more property may receive less ongoing support.
Attorney fee contributions. Under Family Code Section 2030, courts can order one spouse to contribute to the other’s legal fees when income disparities would otherwise prevent adequate representation for the spouse with fewer financial resources.
A property division attorney in Riverside can protect your financial interests during one of life’s most difficult transitions, making sure you receive your fair share of assets and aren’t saddled with more than your fair share of debts. Our firm offers free consultations where we will review your situation, explain how California law applies to your assets, and discuss strategies for achieving an outcome that protects your financial future.
