If you’ve spent years building substantial wealth through a business, stock options, real estate investments, or executive compensation, ending your marriage creates financial questions that most divorce attorneys rarely encounter. Determining the accurate value of a company you built from the ground up requires specialized knowledge, and figuring out what happens to unvested stock options or deferred compensation adds another layer of complexity that demands careful analysis. When multiple properties are involved and both spouses contributed to the marriage in different ways, someone has to determine what a fair buyout actually looks like, and getting that number wrong can cost you hundreds of thousands of dollars.
A Riverside, CA high net worth divorce lawyer can help you work through these financial complexities while making sure you don’t leave money on the table during settlement negotiations or litigation. Schank Family Law has been handling complex asset division cases throughout California for more than twenty years. Contact us today for a free consultation about protecting what you’ve spent your career building.
High-asset divorce isn’t something attorneys can figure out on the fly, because the financial stakes are simply too high and the issues too specialized for a generalist approach. Christian Schank founded this firm more than two decades ago with a focus on family law cases throughout California, and he has spent that time developing the expertise necessary to handle substantial estates, business valuations, and executive compensation disputes. He earned his Juris Doctor from the University of La Verne College of Law and maintains Lead Counsel Verified status through Martindale-Hubbell for family law matters. He also carries an AV rating from Martindale, which represents their highest recognition for professional excellence and ethical standards.
Throughout his career, Christian has represented business owners, physicians, technology executives, and other high-income professionals who understood that their divorce would determine their financial future for years to come. He knows that achieving favorable outcomes in these cases requires more than just understanding California’s community property statutes, it demands familiarity with how businesses get valued in divorce proceedings, how executive compensation packages should be characterized and divided, and when bringing in a forensic accountant makes sense because the numbers your spouse is presenting simply don’t add up.
When a case requires business appraisals, forensic accounting analysis, or expert testimony about executive compensation structures, we coordinate with financial specialists who handle this type of work regularly and understand what divorce courts need to see.
Our family lawyer in Riverside, CA offers free initial consultations for high net worth divorce matters because we believe potential clients deserve the opportunity to understand their situation before making any commitments about representation. During this meeting, you will sit down with an attorney who can review the specifics of your case, identify the financial issues that are likely to become contested, and provide honest feedback about what the process will look like given your particular circumstances.

The approach we take to your case depends largely on where your wealth is concentrated and how it accumulated during the marriage, because different asset types create entirely different challenges during divorce proceedings.
California operates under a community property system, which carries profound implications for divorcing couples who have accumulated substantial wealth during their marriage. Under California Family Code Section 760, nearly everything acquired during the marriage belongs equally to both spouses regardless of whose name appears on the title or account, and regardless of which spouse actually earned the income that purchased the asset.
Several legal rules carry particular weight in high-asset divorce cases, and understanding them before you file can significantly affect your outcome.
The date of separation matters enormously because assets acquired after that date typically remain the separate property of whoever acquired them, which means that in a marriage where wealth continued accumulating right up until the end, disputes about exactly when the separation occurred can swing the financial outcome by hundreds of thousands of dollars depending on what was earned or purchased during the contested period.
Transmutation, changing property from separate to community or vice versa, has strict requirements under California law that trip up many couples who made informal agreements during their marriage. Family Code Section 852 requires that any change in property character be documented in writing with an express declaration, which means that verbal agreements and handshake deals about who owns what generally won’t hold up when challenged in divorce court.
Fiduciary duties between spouses don’t end when divorce papers get filed, which surprises many people who assume they can start protecting their own interests without regard for their spouse once the marriage is clearly over. Under Family Code Section 1101, both spouses continue to owe each other honesty and good faith regarding community assets throughout the divorce process, and violating these duties can result in sanctions including an unequal property division that favors the spouse who was wronged.
Financial disclosure requirements under California law are extensive and carry serious consequences for non-compliance. The California Courts require preliminary and final declarations that comprehensively list all income, expenses, assets, and debts, and failing to disclose something, whether intentionally or through carelessness, can give your former spouse grounds to reopen the divorce judgment years after everything seemed final.

While divorce isn’t structured like a personal injury lawsuit with traditional damage categories, substantial money changes hands during high-asset dissolution proceedings, and understanding what you’re entitled to helps you evaluate whether proposed settlements are actually fair.
Your share of the community estate. California law entitles you to half the net value of all community property accumulated during the marriage, which in wealthy divorces includes your share of business equity, real estate appreciation, investment account growth, and retirement fund accumulation. Getting proper valuations matters enormously here, if a business appraiser undervalues your spouse’s company by $400,000, you just lost $200,000 from what should have been your share of the marital estate.
Spousal support based on statutory factors. Family Code Section 4320 sets forth the factors courts must consider when determining support, including the length of the marriage, the standard of living established during the marriage, each party’s earning capacity, their respective ages and health conditions, any documented history of domestic violence, and whether one spouse made career sacrifices to support the other’s professional advancement. Marriages of long duration frequently result in support obligations that continue for many years or even permanently in some circumstances due to how California’s spousal support system operates.
Reimbursement for separate property contributions. When separate property funds were used to improve community assets, or when community property funds were used to pay down a mortgage on separate property real estate, the contributing estate may be entitled to reimbursement under California case law. These Moore/Marsden calculations can become quite technical, but they have the potential to recover significant sums when substantial money flowed between property categories during the marriage.
Contribution to attorney fees. Under Family Code Section 2030, courts have authority to order one spouse to contribute to the other’s legal fees when a significant income disparity would otherwise leave one party unable to afford adequate representation while the other hires top counsel without financial strain. This provision exists to level the playing field regardless of which spouse happened to control the family finances.
Sanctions for misconduct. Spouses who hide assets, dissipate community property through wasteful spending, or breach their fiduciary duties to the other spouse face potential sanctions that can be quite severe. Courts have authority to award 100% of a concealed asset to the innocent spouse rather than dividing it, and they can impose additional monetary penalties on top of that. Understanding how community property works in California before you file helps you organize your finances appropriately and protect yourself throughout the process.

Our firm provides free consultations where we can review your specific situation, explain what the divorce process typically looks like for substantial estates, and answer your questions about protecting assets, obtaining accurate business valuations, and calculating appropriate support obligations.
