If you are going through a divorce in Monterey and spousal support is part of the conversation, the financial consequences are real. Alimony determines how much money you have to live on for years after a divorce. California courts weigh more than a dozen factors before setting a support amount, and the outcome depends on how the evidence is prepared and presented. Whether you’re asking for support or expect to pay it, the process demands preparation and a clear strategy.
Our Monterey, CA alimony lawyer at Schank Family Law has more than 20 years of experience representing clients in spousal support disputes across California. We handle temporary support hearings, long-term orders, modifications, enforcement actions, and complex high-asset cases. We offer free consultations for all spousal support matters and represent both the paying and receiving spouse.
Not every family law firm has tried the kind of support cases where the monthly number changes someone’s life. Attorney Derek Austin, a California-certified Family Law Specialist, secured a $22,000 per month temporary spousal support award for the spouse of a prominent trucking company owner. He has also negotiated custody and support matters involving professional athletes in the MLB and NFL. That kind of preparation is what we bring to Monterey alimony cases. Our attorneys practice exclusively in family law, and that singular focus shows in the outcomes we produce as a family lawyer in Monterey, CA.
Founding attorney Christian Schank has been admitted to the California State Bar since 2003 and holds an AV Preeminent rating from Martindale-Hubbell, the highest peer-review distinction available for legal ability and ethics. He has maintained Lead Counsel Verified status in family law since 2015. Mariana Hevia-Cockrell brings more than 30 years of California family law practice and has served as a judicial officer in legal proceedings. That vantage point gives her direct insight into how judges evaluate spousal support requests from the bench. Our Monterey office serves clients throughout the county.
Spousal support cases involve more than income spreadsheets and tax returns. They involve career sacrifices, years of marriage, and genuine anxiety about the future. Karissa Piralla brings more than 15 years of legal experience to these cases, including a background in judicial research for the Monterey County Superior Court and appellate-level legal work across multiple court departments. From your first conversation with our firm, we will be honest about your options and direct about what to expect.
We offer free initial consultations for Monterey, CA alimony cases. During that first conversation, we assess your situation honestly and explain the process ahead of you. You will not be pressured, and we will not speak in legal jargon. Our clients consistently note our prompt communication throughout their cases.

Nobody plans for divorce. Most people we talk to didn’t wake up one day and think “this is the path I wanted.” It’s messy, it’s emotional, and somewhere in the middle of all of it, you’re expected to make decisions that will affect your finances and your family for years to come.
California makes it more complicated than most states. Everything from the house to retirement accounts to how much time you get with your kids goes through a process that has real rules and real deadlines. Miss something or agree to the wrong terms early on, and you could be dealing with the consequences long after the divorce itself is a distant memory.
Spousal support is another area where people often get blindsided – either they didn’t know they were entitled to it, or they agreed to an amount without understanding how California courts actually calculate it.
We work with people going through all of this every day. Some cases are straightforward. Others aren’t. Either way, we treat every client like their situation matters – because to them, it does. We proudly serve clients across California, including Monterey and the surrounding area.

Alimony disputes come in many forms. Some resolve through negotiation before a hearing ever takes place. Others require aggressive litigation in front of a Monterey County judge. We handle all of them.
Temporary spousal support. When a divorce is filed, either spouse can request temporary support to cover living expenses while the case is pending. Monterey County judges generally calculate temporary support using a guideline formula based on each party’s net income. In restraining order cases involving domestic violence, a judge may also include temporary support as part of the protective order. We help clients seek or contest these orders from day one.
Long-term spousal support. At the conclusion of a divorce, the court may issue a long-term or permanent support order. There is no formula for long-term awards. The judge must weigh every factor listed under Family Code § 4320, including the marital standard of living, each spouse’s earning capacity, age, health, and the length of the marriage. We prepare detailed evidence addressing each factor so the court sees the full picture.
Spousal support modifications. Circumstances shift after a divorce is finalized. A job loss, retirement, a serious medical condition, or a former spouse moving in with a new partner can all justify revisiting a support order. California allows either party to request a modification when there has been a material change of circumstances since the last order. We represent clients on both sides of modification disputes.
Support enforcement. When a former spouse stops paying what the court ordered, the consequences should be swift. We pursue enforcement through earnings assignments, contempt proceedings, and other remedies available in Monterey County. Unpaid support accrues interest at 10% per year under California law, so delays only make the problem worse.
High-asset alimony disputes. Cases involving business owners, high-income earners, or substantial property division create distinct challenges. Hidden income, stock options, deferred compensation, and retirement accounts all affect what a fair support figure looks like. We work with forensic accountants when high-asset divorces demand deeper financial analysis.
Alimony in mediation and settlement. Not every spousal support dispute requires a trial. Many couples reach agreements through mediation that satisfy both sides and cost significantly less than litigation. We represent clients in mediation sessions and draft settlement agreements that protect their long-term financial interests.
California law uses the term “spousal support” rather than “alimony,” though the terms mean the same thing in practice. The California Courts provide a general overview for individuals representing themselves, but how these statutes apply to a specific case depends entirely on the facts involved.
For temporary support, Family Code § 3600 authorizes the court to order either spouse to pay support while a divorce or legal separation is pending. Monterey County judges generally rely on a county guideline formula that factors in both parties’ net incomes. This number serves as a starting point. A well-prepared Monterey alimony attorney can argue for a deviation when the formula does not account for the full picture.
Long-term support is different. Under Family Code § 4320, the court must consider more than a dozen factors before setting an amount, including earning capacity, marital standard of living, age, health, documented domestic violence, and career sacrifices made during the marriage. There is no formula for long-term awards, and the judge has broad discretion, which is precisely why preparation matters so much.
Duration is governed by statute as well. Family Code § 4336 defines marriages lasting 10 years or longer as “long duration” marriages. In those cases, the court retains jurisdiction over spousal support indefinitely, meaning support can continue for many years or even a lifetime. Couples divorcing after 50 almost always fall into this category, which raises the financial stakes considerably. For shorter marriages, the general guideline is that support lasts about half the length of the marriage, though judges can deviate based on the circumstances.
California also changed its spousal support tax rules effective January 1, 2026, through SB 711. For orders entered on or after that date, the paying spouse can no longer deduct support on California state taxes, and the receiving spouse does not report it as income. This mirrors the federal rule that has been in place since 2019. The Franchise Tax Board provides detailed guidance on how the change applies to existing and modified orders. This shift affects the economics of every alimony negotiation going forward, and we account for it in every case.
This factor carries enormous weight in any Monterey spousal support dispute. The court examines the lifestyle both spouses maintained, including housing costs, vehicles, vacations, and spending patterns. California’s community property rules also influence how income and assets factor into the support analysis. Our attorneys walk clients through financial disclosure requirements early in the case so nothing gets overlooked.
Courts do not only look at what someone earns right now. They evaluate what a spouse is capable of earning based on education, training, and work history. If a supported spouse holds marketable qualifications but has chosen not to work, the court may impute income to that spouse. On the other side, if the paying spouse is voluntarily underemployed or concealing earnings, a Monterey alimony lawyer can present evidence to challenge that.
Did you put your spouse through graduate school? Turn down promotions so they could build their business? Those sacrifices carry real weight under California law. Judges consider how one spouse helped the other build earning capacity, and that analysis can increase both the amount and duration of support.
A 25-year marriage between spouses in their late 50s produces very different support obligations than a 5-year marriage between spouses in their early 30s. Longer marriages and older parties generally mean longer, and sometimes indefinite, support. Short marriages do not automatically result in zero support, but the duration is significantly compressed.
Documented domestic violence directly affects a spousal support outcome. A spouse convicted of domestic violence faces a rebuttable presumption against receiving support under California law. Evidence from protective order proceedings often plays a central role in how the judge evaluates the request. Whether you experienced violence or are defending against allegations, having a Monterey alimony attorney who has navigated these situations is critical.
Spousal support and child support interact in ways that affect both calculations. If a spouse has primary custody and limited ability to work because of the children’s needs, that shapes the court’s view of what is reasonable on both fronts. Financial preparation before filing, including organizing records and understanding your full budget, makes a measurable difference in how your case develops.
