If you’re a father in Monterey going through a custody dispute, a disagreement over child support, or a divorce, you already understand what’s at stake: your relationship with your children. California law gives fathers the same legal standing as mothers when it comes to custody and visitation. But having that right written into a statute and actually securing meaningful time with your kids are two very different things. The distance between what the law says and what happens inside a courtroom is where your attorney makes the difference.
Our Monterey, CA fathers rights lawyer at Schank Family Law has represented parents in family law cases for more than 20 years. We understand the specific challenges fathers face in Monterey County, and we fight for outcomes that protect your time with your children. Whether you need to establish paternity, modify an existing custody order, or defend against allegations threatening your parenting time, we can help. Contact us for a free consultation.
Familiarity With Monterey County Family Courts
Family law matters in Monterey County are heard in Departments 16 and 17 at the Monterey County courthouse. Odd-numbered cases go to Department 16 and even-numbered cases go to Department 17. Child support hearings are held separately at the Marina Courthouse in Department 21. We know how these courtrooms operate and what local judges prioritize.
Christian Schank founded the firm and has been admitted to the California State Bar since 2003. He holds an AV Preeminent rating from Martindale-Hubbell, the highest peer review distinction an attorney can receive, and has maintained Lead Counsel Verified status in family law since 2015. When you need a Monterey family lawyer who understands how judges approach custody and support decisions, that depth of local familiarity matters.
Every attorney at Schank Family Law practices exclusively in family law. That means fathers in Monterey get access to lawyers who handle paternity disputes, custody cases, support calculations, and visitation schedules daily. Derek Austin is a certified Family Law Specialist through the State Bar of California, a distinction held by a small fraction of attorneys statewide. He built his own practice in 2010, merged with Schank Family Law in 2017, and helped expand the firm’s presence across Northern California. Mariana Hevia-Cockrell has practiced family law for over 30 years and has served as a judicial officer, giving her direct insight into how judges evaluate the cases that come before them.
Our attorneys have recovered favorable custody arrangements, negotiated fair support orders, and defended against false allegations in high-conflict proceedings. Derek Austin secured a $22,000 per month temporary spousal support award and negotiated custody and support in cases involving professional athletes. Dr. Thomas Allison prosecuted a contempt jury trial that resulted in 95 counts of contempt for violation of custody orders. That level of courtroom preparation matters when a father’s parenting time hangs in the balance.
We offer free consultations for Monterey fathers’ rights cases. From the first phone call, we explain your options in plain terms without legal jargon or runaround.

Fathers’ rights cases cover a broad range of family law matters. Some resolve quickly through negotiation. Others involve multiple contested issues across hearings that stretch for months. Below are the areas where we represent fathers in Monterey County.
Child custody. We represent fathers seeking joint or sole custody arrangements. California courts begin from the position that both parents have equal rights, and we hold them to that standard. Whether your case involves an initial custody determination or a modification of an existing order, we build the strongest possible case for your parenting time. Fathers should also understand the difference between physical and legal custody and how each type affects daily decision-making.
Child visitation. Visitation schedules should reflect a father’s actual involvement in his children’s lives. We negotiate and litigate parenting plans that provide meaningful, consistent time rather than a token weekend arrangement.
Child support. Whether you are seeking support or defending against an amount that does not reflect your actual income, we handle both sides. California uses a statewide guideline formula under Family Code § 4055, but courts can deviate from the guideline when circumstances justify it.
Paternity establishment. Unmarried fathers in California must establish paternity before they can assert custody or visitation rights. We guide fathers through voluntary declarations and contested paternity actions to secure legal recognition. The California Courts self-help portal provides a basic overview of this process, but working with an attorney is strongly recommended.
Divorce. Divorce cases frequently bring fathers’ rights issues to a head. We handle the full scope of dissolution proceedings, including property division, spousal support, and contested custody within the same case.
Restraining order defense. False or exaggerated restraining orders can devastate a father’s custody position. We defend fathers against these allegations aggressively while working to preserve their access to their children.
Guardianship. Some situations require a father to pursue legal guardianship of a minor rather than traditional custody, particularly when the child is not biologically his or when a parent is incapacitated. We handle these proceedings in Monterey County.
California’s Family Code is gender-neutral on custody. Family Code § 3010 states that the mother and the presumed father are equally entitled to custody of a child. There is no legal presumption that favors mothers.
The court’s overriding concern in every custody dispute is the child’s health, safety, and welfare. Family Code § 3020 declares it California public policy that children should have frequent and continuing contact with both parents after separation. That policy works in a father’s favor when he has been actively involved in his child’s life.
When judges make custody determinations, Family Code § 3011 sets out the factors they weigh: the child’s safety, any history of abuse, and the nature and extent of each parent’s relationship with the child. A parent’s sex cannot be a factor. California law also directs courts to consider which parent is more likely to allow the child continuing contact with the other parent. That provision can become a powerful tool for a father who has consistently supported the mother’s involvement while she has restricted his.
For unmarried fathers, establishing paternity is the threshold step. Without a voluntary declaration or a court order recognizing paternity, a father has no standing to pursue custody or visitation.
Despite gender-neutral statutes, some fathers walk into court at a perceived disadvantage. The way you demonstrate your involvement in your child’s daily life can shift the trajectory of a case significantly. School attendance records, medical appointment logs, text messages showing you coordinate schedules, and calendars documenting overnights all paint a picture of an engaged parent. A Monterey fathers rights lawyer helps you organize and present this evidence before you ever sit in front of a judge.
Contested custody cases in Monterey County typically go through Family Court Services for mediation or recommending counseling. Neutral mental health professionals meet with both parents and issue a recommendation to the judge. These recommendations carry real weight. How you prepare for and conduct yourself during these sessions can determine the direction of your case. We walk our clients through what to expect and how to present their involvement effectively.
Some custody disputes involve domestic violence allegations that are exaggerated or fabricated. A Monterey, CA fathers rights lawyer who has handled these situations knows how to respond. We gather evidence, prepare declarations, and build a defense that addresses the claims directly while keeping the focus on your relationship with your child. Contempt of court issues also arise when one parent refuses to follow existing custody or visitation orders.
Not every fathers’ rights case is adversarial. Sometimes the goal is a co-parenting arrangement that works for everyone. We help fathers negotiate parenting plans that account for work schedules, travel demands, holidays, and the children’s particular needs. When the other parent is willing to cooperate, mediation often produces better outcomes than litigation and costs significantly less.
Many fathers enter the process carrying custody misconceptions that work against them. Some believe mothers automatically receive primary custody. Others assume that paying child support guarantees specific visitation rights. Neither is true under California law. Knowing what the statute actually says, and what Monterey County courts actually do in practice, gives you a real advantage.
