Take the Right Step Forward
If you’re an unmarried father in California, establishing paternity is the single most important legal step you can take to protect your relationship with your child. Without it, you have no enforceable rights to custody, parenting time, or decision-making authority—and your child has no legal claim to your financial support, medical benefits, or inheritance.
Key Takeaways:
- Paternity can be established through the presumption of marriage, signing a Voluntary Declaration of Parentage (VDOP) at the hospital, or through a court order—each carrying different legal consequences and risks.
- Signing a VDOP has the same legal effect as a court judgment, and once the 60-day rescission window closes, challenging it requires proving fraud, duress, or material mistake of fact.
- If you believe you might be a child’s father, acting quickly protects both your parental rights and your child’s future.
Your Rights Matter—And So Does Your Child’s Future
If you’re uncertain about where you stand legally with your child, the stakes are higher than most people around you probably realize. You may have signed paperwork at the hospital without fully grasping what it meant. Maybe you weren’t married to your child’s mother and are now realizing you don’t have the legal standing you assumed. Or maybe someone is claiming you’re the father, and you need answers before your life changes permanently.
Whatever brought you here, there are clear, actionable steps you can take. Under California Family Code Section 7570, the state has declared a compelling interest in establishing paternity for all children—because it is the foundation for child support, custody rights, and access to critical benefits. Here’s how the process works.
The Presumption of Paternity: When Marriage Creates Legal Fatherhood
Under Family Code Section 7540, if a child is born while a couple is legally married, the husband is presumed to be the legal father. That presumption also applies if the child is born within 300 days of the marriage ending.
Where this becomes a high-stakes issue: if a marriage is deteriorating and one spouse is involved in a relationship outside the marriage, a child born during that period is still legally presumed to be the husband’s. That means the husband could face child support obligations for a child who is not biologically his, solely because of timing.
The marital presumption does not account for biological reality. A father may have a limited window—often as short as two years—from the child’s birth to challenge paternity established through this presumption. If you don’t address it within that window, untangling the situation later becomes exponentially harder and more expensive.
The Voluntary Declaration of Parentage (VDOP): Understand Before You Sign
The VDOP is the form you’re presented with at the hospital after a child is born. It allows the father’s name to be placed on the birth certificate—and under Family Code Section 7573, a signed VDOP has the same force and effect as a court judgment establishing paternity.
For fathers who are confident about their biological connection, the VDOP has real strategic advantages. It immediately establishes your legal rights, positions you to seek custody and parenting time from day one, and makes you the recognized legal father without the need for court proceedings.
But if there is any doubt about whether you are the biological father, signing that document is one of the most consequential mistakes you can make. Under Family Code Section 7575, you have only 60 days to rescind a VDOP without cause. After that window closes, challenging it requires proving fraud, duress, or material mistake of fact under Section 7576—a significantly higher legal bar. We’ve seen cases where men signed in good faith, only to discover later the child was not theirs, facing substantial support obligations with severely limited options for relief.
The bottom line: if you are certain you’re the father, the VDOP protects you. If you have even a shadow of doubt, do not sign until you’ve spoken with an attorney or obtained genetic testing.
Establishing Paternity Through the Courts
The third method—and often the most strategically sound—is filing a Petition to Establish Parental Relationship with the California Superior Court. Either parent, or even the Department of Child Support Services, can initiate this process. The court may order genetic testing, which provides at least 99% accuracy in determining biological parenthood under Family Code Sections 7600 through 7730.
A father can also file to prove he is not the father. If someone is claiming paternity and you’re uncertain, you have the right to petition for court-ordered DNA testing. Conversely, if you believe you’re the father and the mother won’t acknowledge it, you can file to establish your parental rights through the court.
The court process eliminates ambiguity. Once paternity is established this way, both parents’ rights and obligations—including child support, custody, parenting time, and decision-making authority—can be addressed in the same proceeding.
Why Waiting Is the Worst Strategy
Whether you believe you might be a father or you know you are one, delay is your biggest liability.
Fathers who wait years to establish paternity forfeit irreplaceable time with their children and face a more complicated legal landscape. Courts may view unfavorably a father who knew about a child but failed to act. Mothers who delay miss out on the financial support their children deserve. And men paying support for a child they suspect isn’t biologically theirs face strict time limits—once those deadlines pass, you may be legally obligated to continue paying regardless of biological reality.
What Happens After Paternity Is Established
Once paternity is legally established, both parents stand on equal footing. The father can seek custody and parenting time; the mother can seek child support. The court will allocate custody and decision-making responsibilities based on the child’s best interests.
Paternity also unlocks critical benefits for your child: medical insurance through either parent, inheritance rights, family medical history, and eligibility for Social Security or veterans’ benefits. For fathers, it is the foundation for building a meaningful co-parenting relationship and having the legal standing to participate in the decisions that shape your child’s future.
