Types of Monterey Same-Sex Divorce Cases We Handle
Same-sex dissolution follows the same legal framework as any California divorce, but certain issues surface more frequently in these cases. Timing, how parental rights were created, and assets that accumulated before LGBTQ relationships had legal recognition all create additional layers of complexity. We handle these cases throughout Monterey County.
- Divorce. We represent both petitioners and respondents in full dissolution proceedings, from filing through final judgment. This includes contested and uncontested cases, as well as cases where a registered domestic partnership must also be dissolved.
- Property division. California splits community property equally, but for same-sex couples, determining when the community property clock started is often far more complicated. If you purchased a home together years before you were legally able to marry, that changes the analysis significantly. Tracing commingled assets from those pre-marriage years requires careful financial work.
- Spousal support. Courts evaluate factors like marriage length, income, earning capacity, and the standard of living during the marriage when setting support under Family Code § 4320. For couples whose relationship predates their legal marriage by a decade or more, the court has discretion to weigh that full history when calculating support.
- Child custody. Parental rights in same-sex divorces often involve layered situations. One parent may be the biological parent, while the other is adopted, or both parents were adopted together. How parentage was legally established matters when custody is contested, and errors in documentation can threaten a parent’s standing entirely.
- Child support. California calculates child support using a statewide guideline formula. We make sure the numbers reflect the real financial picture of both parents and the actual custody arrangement currently in place.
- Mediation. When both sides are willing to negotiate, mediation can resolve property, support, and custody disputes faster and for significantly less money than a trial. We represent clients in mediation and help structure agreements that hold up long-term.
California Legal Requirements for Same-Sex Divorce
California is a no-fault state. Under Family Code § 2310, you can file for dissolution by citing irreconcilable differences. You do not have to prove your spouse did anything wrong, and they do not have to agree to the divorce.
There is a residency requirement. Per Family Code § 2320, at least one spouse must have lived in California for six months and in Monterey County for three months before filing. Same-sex couples have an important exception: if you were married in California and now live somewhere that will not dissolve your marriage, you can still file in the California county where you got married. The California Courts self-help portal explains these residency rules in detail.
Property division follows Family Code § 760. Anything acquired during the marriage while domiciled in California is presumed community property: wages, real estate, retirement accounts, and most other assets. What you owned before the marriage, or received as a gift or inheritance, stays separate. For same-sex couples who lived together for years before marriage became available in California, drawing that line between community and separate property gets harder. A thorough financial disclosure early in the case is critical.
Important Aspects of a Monterey Same-Sex Divorce Case
Same-sex dissolution follows the same rules as any California divorce, but several issues come up more often in these cases and deserve close attention.
Determining the Community Property Start Date
Same-sex marriage has only been continuously legal in California since 2013. Many couples were together well before that date. The community property clock typically starts at the date of marriage or registered domestic partnership, not when you first moved in together. Commingled bank accounts, joint real estate purchases, and shared debts from those earlier years create tracing challenges. California’s community property rules require careful analysis when the financial relationship predates the legal one by many years.
Parentage and Custody Standing
If one spouse is the biological parent and the other is not, the non-biological parent’s rights depend entirely on whether a legal parent-child relationship was created. Adoption, a voluntary declaration, or a court order can establish that link. Without it, a spouse will not have presumed parental rights. Parentage documentation should be reviewed early in any Monterey same-sex divorce where children are involved.
Marriage Length and Spousal Support
Courts factor in how long the marriage lasted when setting alimony. A couple together for 15 years but legally married for 5 can ask the court to consider the full duration of the relationship. This does not happen automatically. Your attorney has to present evidence of cohabitation, shared finances, and interdependence to make that argument successfully.
Domestic Partnership Dissolution
Some same-sex couples registered domestic partnerships in California instead of marrying. Dissolution follows mostly the same process as divorce, but if you registered a partnership and later married, both relationships need to be addressed in the proceedings. California treats domestic partners and spouses identically for property division and support purposes. If you are unsure whether legal separation or full dissolution is the right path, we can walk you through the differences.
Retirement Benefits and Military Pensions
Splitting retirement accounts and military pensions requires specific court orders. For same-sex spouses, when federal benefits became available is directly relevant to what is subject to division. The 2015 Obergefell v. Hodges ruling and the earlier United States v. Windsor decision in 2013 changed the landscape, and the timing of those rulings affects your case.
Domestic Violence and Protective Orders
Domestic violence occurs in every kind of relationship, and California law does not distinguish based on the gender of either spouse. Same-sex couples receive the same protections as anyone else. If you need a protective order during your divorce, we can help you file through the Monterey County courts.
