If you or your spouse serves in the military and you’re facing a divorce in Monterey, the legal issues are different from what a civilian couple would deal with. Federal statutes layer on top of California family law. Military retirement pay does not divide like a 401(k). Custody schedules have to account for deployments, PCS orders, and potential relocations to other states or overseas. BAH and BAS affect support calculations differently from civilian income, and treating a Monterey military divorce like a standard dissolution is a costly mistake.
Our Monterey, CA military divorce lawyer at Schank Family Law has represented California families for more than two decades. We work with servicemembers stationed at the Defense Language Institute, the Naval Postgraduate School, and other installations across the Monterey Peninsula. We handle Monterey military divorce cases from petition to final judgment, including retirement division, custody disputes tied to military service, and support orders that account for military compensation. Contact us for a free consultation.
Family law matters in Monterey County go through Departments 16 and 17 at the Monterey County family court. Our firm has handled cases in these courtrooms for more than 20 years, and we understand how local judges approach custody, support, and property division in military family cases. Founding Attorney Christian Schank was admitted to the California State Bar in 2003 and has built a firm serving families across multiple California counties, including Monterey, Santa Clara, and San Benito. A family divorce lawyer in Monterey, CA who has practiced in these departments understands which arguments resonate with local judges and how Monterey military divorce cases move through the system.
Our firm includes an attorney who served in the United States Army. We understand military pay structure, the real-world impact of a PCS order on custody, and how the Servicemembers Civil Relief Act affects case timelines. We know what a Leave and Earnings Statement looks like, how BAH calculations work, and why the difference between a Retirement Benefits Court Order and a QDRO matters in every Monterey military divorce case we take.
Our attorneys bring specific credentials to Monterey, CA military divorce cases. Christian Schank holds an AV rating from Martindale-Hubbell and has maintained Lead Counsel Verified status in family law since 2015. Derek Austin is a certified Family Law Specialist through the State Bar of California, a distinction held by a small percentage of California attorneys. He merged his own established practice into the firm in 2017 and has published an appellate opinion from the California Court of Appeals. Our founding and senior attorneys have secured significant spousal support awards, prevailed in contested custody matters involving professional athletes and high-income business owners, and prosecuted contempt actions resulting in 95 counts of contempt for custody order violations.
We offer free consultations for Monterey military divorce cases. We explain what California and federal law require, what your options are, and what to expect from the process.

“I hired the Schank Family Law firm for a legal issue. I cannot praise this firm enough for their professionalism and prompt responses to the court as well as being transparent with their actions on my behalf. They do not nickel and dime you as well for their work. They are an outstanding firm and if you need a great law firm to work with, I highly recommend them to everyone.” – Julienne Villegas

Military families deal with issues that civilian divorces rarely touch. Federal law intersects with California’s community property system at every stage of a military dissolution. We represent servicemembers, military spouses, and veterans in the family law matters that arise during or after military service.
Filing for divorce in California requires that at least one spouse has lived in the state for six months and in the filing county for at least three months, as outlined by the California Courts. Under California Family Code § 2320, each spouse can maintain a separate domicile. For military families stationed at Monterey-area installations, that residency question gets complicated because the military can reassign you at any time.
California is a no-fault state. Neither spouse has to prove wrongdoing. Irreconcilable differences are the only grounds needed. Every California divorce carries a mandatory six-month waiting period from the date of service before the court can enter a final judgment. For military families facing an upcoming PCS date, coordinating that timeline with military orders is essential.
Federal law adds significant complexity. The Servicemembers Civil Relief Act allows an active duty servicemember to request a stay of civil proceedings, including divorce, if military duties materially affect their ability to participate. Monterey County Superior Court requires specific documentation of military status before entering any default judgment.
The Uniformed Services Former Spouses’ Protection Act, codified at 10 U.S.C. § 1408, is the federal statute that authorizes state courts to treat military retired pay as divisible property. Without a court order that complies with DFAS formatting requirements, a former spouse loses the ability to collect their share of retirement pay directly. Getting this right the first time is critical.
This is almost always the most complex financial issue in a Monterey military divorce. The “time rule” formula calculates the community property share by comparing the length of the marriage during military service to the total creditable service. The servicemember’s attorney will argue for a narrower calculation, while the non-military spouse’s counsel will push to maximize the marital share. Under California Family Code § 2610, the court must make whatever orders are necessary to ensure each party receives their full community property share. The final order must meet DFAS specifications, or the division will not happen as intended. Proper financial disclosure is essential to an accurate division.
A parent cannot lose custody simply because they are deployed, but the opposing side will often try to use a lengthy absence to argue for a permanent change in primary physical custody. California courts must consider the child’s best interests without penalizing a parent for fulfilling military obligations. We build parenting plans that address what happens during deployment, during extended training, and after the servicemember returns. For families facing potential relocations, California’s move-away laws impose additional requirements on the relocating parent.
BAH and BAS are not treated as taxable income by the IRS. California courts, however, generally include them when calculating child support and alimony. The servicemember’s side argues for exclusion, and the non-military spouse’s counsel pushes for full inclusion. Complete disclosure of all military compensation, including special pay, hazardous duty pay, and separation allowances, is essential to an accurate calculation. Cases involving high-earning servicemembers or business income on top of military pay demand additional analysis.
The TSP functions as the military’s version of a 401(k) and is subject to division as community property in a California military divorce. The process differs from dividing a private retirement account. The TSP requires a Retirement Benefits Court Order rather than a standard Qualified Domestic Relations Order. The TSP court order requirements are specific, and getting the order type wrong means months of delay and potential loss of benefits for the non-military spouse.
If one spouse is on active duty, the SCRA can pause divorce proceedings. This protection exists so that servicemembers are not disadvantaged by their inability to appear in court. It is not an indefinite hold, but it can delay the process significantly. Planning around deployments, TDY assignments, and training schedules matters when you are trying to finalize a Monterey military divorce within a reasonable timeframe. During any delay, what you post on social media can become evidence in your case.
