Myths About Child Custody Parents Should Stop Believing

Few legal matters feel as personal as child custody. When parents separate, they often bring along ideas picked up from friends, relatives, television, or a late-night search online. Some of those ideas are harmless. Others lead to decisions that weaken a parent’s position or add stress for the children caught in the middle.
We think it helps to clear up the most common misunderstandings early. Our friends at Felt Family Law and Mediation discuss how a child custody lawyer can help parents separate fact from assumption before they make choices that are hard to undo. Below are the myths we hear most often from parents sitting across the desk from us.
Mothers Automatically Get Custody
This belief has hung around for decades. In most courts today, the focus is on the child’s best interests, not the gender of the parent. Fathers can and do receive primary or shared custody.
What tends to carry weight is the relationship each parent has with the child, how involved each has been in daily life, and who can offer a stable, supportive home.
Children Get to Decide Where They Live
A child’s preferences may be considered, especially as they get older and show more maturity. But those wishes are usually one factor among many. Judges are careful here. They don’t want a child to feel responsible for choosing between parents.
And pressuring a child to “pick a side” almost always backfires.
Custody and Child Support Are the Same Issue
They’re connected, but they are legally separate. If the other parent falls behind on support, that generally does not give you the right to withhold parenting time. The reverse is also true. Paying support doesn’t earn a parent extra time with the kids.
Taking matters into your own hands, even when you feel justified, can damage your credibility later.
Equal Time Is Guaranteed
Many parents walk in assuming a 50/50 split is automatic. Some arrangements do end up close to equal. Plenty don’t. Courts often look at practical details such as:
- Each parent’s work schedule
- The distance between homes and the child’s school
- The child’s age and specific needs
- Which parent has handled day-to-day caregiving
- Any concerns about safety or stability
The goal is a schedule that works for the child, not a perfect mathematical split.
Custody Orders Can Never Be Changed
Orders aren’t set in stone. When circumstances shift in a meaningful way, a parent may ask the court to modify the arrangement. A planned move, a change in a child’s needs, or new safety concerns are common reasons.
That said, courts value stability, so minor disagreements usually aren’t enough. It’s also worth knowing that informal changes between parents, even friendly ones, may not be enforceable unless they’re made official.
Every Custody Case Ends in a Courtroom Battle
Not true.
Many parents reach agreements through negotiation or mediation. Working out your own arrangement often gives you more control over the result and tends to be easier on everyone, especially the children. Court remains an option when cooperation isn’t possible or when there are real concerns about a child’s well-being.
Your Behavior Outside Court Doesn’t Matter
It does. How you speak to the other parent, what you post on social media, and whether you follow the current schedule can all come up during a custody dispute. We often tell parents to keep every message calm and respectful. Write each one as if a judge might read it someday, because one might.
If you’re facing a custody decision, or you have questions about an arrangement that no longer fits your family, it can help to connect with an attorney who can explain your options and what to expect along the way.
