Relocating with Children After Divorce: California’s Move-Away Laws and Requirements

Moving with your children after a California divorce requires following specific legal procedures that depend on your current custody arrangement. Whether you can relocate depends on factors like whether you have sole or joint custody, the distance of the move, and how it affects your child’s best interests.

Key Takeaways:

• Parents with sole physical custody have a presumptive right to relocate with their children, but the other parent can challenge the move by proving it would negatively impact the child’s well-being.

• Parents with joint physical custody must typically get court approval or the other parent’s consent before moving, as they must prove the relocation is in the child’s best interests.

• All relocations that interfere with existing custody orders require either mutual agreement between parents or a court order before the move can happen.

Starting a new life after divorce often involves making difficult decisions, and few are more challenging than wanting to relocate with your children. Maybe you’ve received a job offer in another state, want to be closer to family, or simply need a fresh start somewhere new. Whatever your reasons, moving with children after divorce in California involves navigating complex legal requirements that can significantly impact your family’s future.

Understanding California’s move-away laws isn’t just about legal compliance—it’s about protecting your relationship with your children and respecting the other parent’s rights. The court system aims to balance your freedom to make life decisions with your child’s need to maintain meaningful relationships with both parents.

What Exactly Is a Move-Away Case?

In California family law, a move-away case (also called a relocation case) occurs when a parent wants to move with their child to a location that would interfere with the current custody and visitation schedule. There’s no specific distance that automatically triggers these requirements—it depends entirely on whether the move would disrupt the existing parenting arrangement.

For example, moving across town might not require court approval if both parents can still follow the current custody schedule. However, moving from Los Angeles to San Francisco—or to another state entirely—would likely interfere with regular visits and require legal action.

Your Rights Depend on Your Custody Arrangement

The biggest factor determining your ability to relocate is your current custody arrangement. California law treats parents with sole physical custody very differently from those with joint custody.

If You Have Sole Physical Custody

Parents with sole physical custody have what’s called a “presumptive right” to relocate with their children. This means the law generally assumes you should be able to move, and the burden falls on the other parent to prove that relocating would harm your child.

However, this right isn’t absolute. The California courts can still prevent a move if they determine it would “prejudice the rights or welfare” of your child. The non-custodial parent can challenge your relocation request by filing for a custody modification and demonstrating that the move would negatively impact your child’s well-being.

If You Have Joint Physical Custody

When parents share joint physical custody, the rules become more restrictive. Since both parents have equal rights to physical custody time, one parent can’t unilaterally decide to move away with the children. In these situations, you must either:

• Get written consent from the other parent
• Obtain a court order allowing the relocation
• Prove to the court that the move is in your child’s best interests

The burden of proof is on you to show why the move benefits your child, not just why it benefits you.

What the Court Considers When Making Decisions

California judges must always prioritize the child’s best interests when deciding move-away cases. While every situation is unique, courts typically examine several key factors:

Distance and Impact on Relationships

How far are you moving, and how will this affect your child’s relationship with the other parent? A move from San Diego to Los Angeles might allow for weekend visits, while relocating from California to New York would drastically limit in-person contact. Courts also consider the practical aspects, like whether the other parent can afford to travel for visits, and who would pay for transportation costs.

Reasons for the Move

The court wants to understand your motivation for relocating. Common legitimate reasons include:

• Employment opportunities that improve your family’s financial stability
• Being closer to extended family support systems
• Better educational opportunities for your child
• Remarriage to someone who lives elsewhere
• Health reasons requiring specific medical care

However, if the court suspects you’re moving primarily to limit the other parent’s access to your child, this will work against you significantly.

Quality of Current Relationships

How involved is each parent in the child’s daily life? What’s the quality of the child’s relationship with both parents? A parent who rarely exercises their visitation rights will have less standing to prevent a move than one who’s actively involved in their child’s life.

The Child’s Age and Adjustment

Younger children may adapt more easily to relocation, while teenagers might struggle with leaving friends and familiar surroundings. For older children, some courts may consider the child’s preferences, though this varies by case.

Co-Parenting Relationship

Courts examine how well parents communicate and cooperate. Do you support your child’s relationship with the other parent? Have there been issues with following court orders or undermining the other parent? Your track record of co-parenting cooperation can influence the judge’s decision.

The Legal Process: What You Need to Know

If you’re planning to relocate, don’t pack up and move first—this could result in serious legal consequences, including losing custody of your children.

Review Your Current Orders

Start by carefully reviewing your existing custody order or divorce judgment. Many include specific requirements about relocation, such as:

• How much advance notice you must give the other parent (often 45-60 days)
• Maximum distances you can move without permission
• Requirements for written notice to the other parent and their attorney

Attempt to Reach Agreement

Before heading to court, try to work out an arrangement with your child’s other parent. Many parents can reach agreements about modified visitation schedules, transportation costs, and communication plans that accommodate the relocation. Having an agreement makes the entire process faster, less expensive, and less stressful for everyone involved.

File a Request for Order

If you can’t reach an agreement, you’ll need to file a Request for Order with the family court. This legal document explains your reasons for wanting to move and proposes how the relocation would be in your child’s best interests. You’ll also need to suggest a modified parenting plan that allows the other parent to maintain meaningful contact with your child.

Prepare for Court

Move-away cases often require extensive preparation. You may need to gather evidence supporting your reasons for relocating, document your child’s current living situation, and demonstrate how you’ll facilitate ongoing contact with the other parent. Some courts order custody evaluations to assess the family dynamics and make recommendations.

Protecting Your Child Through the Process

Regardless of the legal complexities, remember that this process affects your child most of all. Children thrive on stability and maintaining close relationships with both parents. As you navigate your move-away case, consider how you can minimize disruption to your child’s life.

Be honest with your child about the potential move in age-appropriate ways, but avoid making promises about the outcome until the court has decided. Don’t involve your child in adult discussions about the legal process or criticize the other parent for opposing the move. The American Academy of Pediatrics provides helpful guidance on supporting children through family transitions.

If the court approves your relocation, work diligently to maintain your child’s relationship with the other parent through video calls, longer summer visits, and holiday arrangements. The goal should be ensuring your child benefits from strong relationships with both parents, even from a distance.

Special Considerations for Out-of-State Moves

Moving to another state adds additional legal complexities that require careful attention. Once you move out of California with your child, questions arise about which state’s courts will have jurisdiction over future custody matters. This becomes particularly important if you later need to modify custody or support orders.

Before finalizing any out-of-state move, consult with an attorney experienced in interstate custody issues. They can help ensure your relocation agreement addresses jurisdictional questions and protects your rights if future modifications become necessary.

When Things Go Wrong

What happens if you move without permission or if the other parent takes the children and relocates without following proper procedures? These situations can have serious legal consequences, including emergency court orders requiring the children’s return and potential changes to custody arrangements.

If you believe the other parent is planning to move without proper authorization, document your concerns and consult with a family law attorney immediately. Similarly, if you’ve already moved and later discover you didn’t follow proper procedures, seek legal counsel right away to address the situation.

Moving Forward with Confidence

California’s move-away laws recognize that life circumstances change and that sometimes relocation truly serves a child’s best interests. According to U.S. Census Bureau data, millions of Americans relocate each year for various reasons, and divorced families are no exception. At the same time, these laws protect children’s rights to maintain relationships with both parents whenever possible.

The key to successfully navigating a move-away case lies in thorough preparation, understanding your legal rights and obligations, and keeping your child’s well-being at the center of every decision. Whether you’re seeking to relocate or are concerned about your child moving away, having experienced legal guidance can make all the difference in achieving an outcome that works for your family.

Remember that move-away cases can take months to resolve, so start the legal process well before any planned relocation date. Courts need time to carefully consider all factors, and rushing the process rarely leads to favorable outcomes.
