Mountain View sits beside Moffett Federal Airfield, and military families in the area can face rules that most civilian divorces never touch. Retired pay, deployment schedules, and federal court protections can all shape a case. The answers below explain a few of the main points.
Can a Court Divide Military Retired Pay?
Yes, in the right circumstances. Under 10 U.S.C. 1408, a state court may treat a service member’s disposable retired pay as property of the member alone or as property of the member and spouse, depending on state law. California is a community property state, so a spouse may have a claim to part of the portion earned during the marriage. The details depend on the service record and the dates involved.
Is There a Limit on What the Government Pays Directly?
Yes. The statute caps the total retired pay payable under all court orders treating it as property at 50 percent of disposable retired pay. It also adds a 10-year overlap requirement for direct payment from the Defense Finance and Accounting Service. The spouse must have been married to the member for at least 10 years during which the member performed at least 10 years of creditable service. A marriage that falls short may still produce a property award, but the spouse might need to collect it another way.
Which Court Has Authority Over the Service Member?
A court may divide retired pay only if it has jurisdiction over the member on one of three grounds: residence in the court’s territory other than because of a military assignment, domicile there, or the member’s consent. That rule isn’t a technicality, since it can affect where a case is filed. A service member stationed in California for work may not count as a resident for this purpose. Questions of this kind are worth sorting out before anyone files.
What Protections Apply If a Service Member Doesn’t Respond?
The Servicemembers Civil Relief Act adds safeguards in civil cases. Under 50 U.S.C. 3931, a plaintiff seeking a default judgment must file an affidavit stating whether the defendant is in military service. If the defendant is in service, the court must appoint an attorney before entering judgment, and it must grant a stay of at least 90 days in certain situations. A default entered against a service member during service can later be reopened on application.
Default cases come up when a spouse never responds to the papers, and a default hearing is where the court decides how to proceed. The military spouse’s absence or deployment can complicate that step.
How Does a Military Case Differ From Other Divorces?
Several features set these cases apart:
- Retired pay and survivor benefits may be on the table
- Deployments can complicate parenting schedules
- Federal rules can affect timing and notice
- Housing and healthcare benefits may change after divorce
Standard steps still apply too. Both spouses must exchange financial disclosure documents, and military pay records belong in that exchange.
What Happens to a Pension Beyond Retired Pay?
Not every military case turns on retired pay alone. Other retirement assets, such as savings plans earned during the marriage, can also be divided. Pension questions like these come up for nearby San Jose families too, and a San Jose pension division lawyer can explain how courts approach them.
Can a Case Be Filed Where the Family Lives?
California has residency rules for filing, and those rules matter when a family moves because of orders. Before choosing a court, military families should confirm that they meet the California residency rules.
Where Can Mountain View Families Find Help?
Families can turn to a Mountain View divorce lawyer to review the service record, identify the retired pay questions, and explain how federal and state rules fit together. Early review also helps in spotting deadlines tied to the service member’s duty status.
Community property issues add another layer, and a Mountain View property division lawyer can address how assets and retirement benefits are characterized and divided. Benefits earned during the marriage can require careful tracing.
