Is California A Community Property State?
Yes. Under California Family Code Section 760, nearly everything either spouse earns or acquires during the marriage is presumed to belong equally to both of them, regardless of whose name appears on the account or title. This default rule shapes almost every financial conversation in a San Jose divorce from the very first meeting.
Does That Mean Everything Gets Split In Half?
Community property does, yes, though not necessarily asset by asset. A court can award one spouse the family home while giving the other spouse a larger share of retirement accounts to balance things out, as long as the overall division comes out roughly equal. A San Jose property division lawyer can help map out this kind of offsetting division before either spouse commits to keeping a specific asset. Separate property, generally anything owned before the marriage or received individually as a gift or inheritance, is not divided at all and stays with the spouse who owns it.
What Is The Date Of Separation And Why Does It Matter?
This is one of the most consequential facts in any California divorce. The date of separation marks the point when one spouse expressed an intent to end the marriage and began acting consistently with that intent, and property or income acquired after that date generally counts as separate rather than community. Disputes over the exact date are common, since a few weeks can shift whether a bonus, a business gain, or a debt gets divided or kept by one spouse alone. Courts look at actual conduct, not just a stated intention, so moving into a separate bedroom without any other change in the relationship is rarely enough on its own to establish the date.
What Counts As Community Property In Practice?
The list below covers what typically falls into this category before any negotiation begins.
- Income earned by either spouse during the marriage, regardless of whose name is on the paycheck
- Real estate purchased during the marriage, even if only one spouse is on the title
- Retirement contributions and appreciation that occurred during the marriage
- Debts incurred during the marriage, which get divided along with the assets
Can A Business Or Retirement Account Be Part Separate And Part Community?
Yes, and this is where cases get complicated quickly. A business started before the marriage but grown using community labor or funds during the marriage often has to be split into separate and community components through a valuation process. The same issue comes up with retirement accounts that were partially funded before the wedding, where only the portion earned during the marriage is subject to division, requiring a specialized calculation rather than a simple percentage split of the account balance.
Do I Need To File For Divorce In A Specific County?
California requires at least six months of residency in the state, and three months in the specific county before filing, so a recent move to San Jose can affect where and when a case gets started. Schank Family Law helps clients confirm residency questions like this early, since filing in the wrong county can delay a case before the property division questions even get addressed.
How Does Hidden Or Wasted Property Get Handled?
California treats deliberately hiding assets or wasting community funds, through gambling, an affair, or reckless spending, as a serious issue a court can address by awarding the other spouse a larger share of what remains. Full financial disclosure is required by law during a divorce, and a San Jose property division lawyer can help identify red flags in financial records that suggest something is being concealed before it becomes too late to trace.
