- The marriage lasted no more than five years from the date of marriage to the date of separation
- Neither spouse owns any real estate or has an interest in real estate (including a lease with an option to buy)
- The couple has no unpaid debts from the marriage exceeding $6,000, excluding car loans
- The total fair market value of community property is less than $47,000, excluding cars
- Neither spouse’s separate property exceeds $47,000 in value
- Neither spouse is requesting spousal support
- Both spouses agree on how to divide all property and debt
- Both spouses have read the Summary Dissolution Information booklet provided by the California courts
If any one of these requirements is not met, the couple must use the standard dissolution process instead.
What a Summary Dissolution Cannot Resolve
Summary dissolution is not available for couples with children from the marriage or for any case where one spouse is requesting spousal support. It also cannot address real property, which means couples who own a home together must use standard divorce proceedings to resolve the property division, regardless of how short the marriage was.
