California Family Code Section 721 and the UPAA require that the party presented with the agreement have a minimum of seven days between when they first received it and when they signed it. An agreement handed to one spouse the morning of the wedding ceremony, or signed under emotional pressure, faces serious challenges in court.

- Lack of voluntary consent, where one party signed under duress or was pressured by the other party or their family
- Inadequate financial disclosure, where one party failed to fully disclose their assets, debts, or income before signing
- Unconscionability, where the terms are so one-sided that enforcing them would be fundamentally unfair under the circumstances at signing
- Improper execution, including failure to meet the seven-day requirement or absence of independent legal advice
- Changed circumstances, where the agreement was valid at signing but circumstances have changed so substantially that enforcement would produce an unjust result
