Protection Rarely Comes In Just One Form
California does not offer a single, one-size-fits-all restraining order for domestic violence situations. Instead, the law provides four distinct types of protection, each triggered at a different point in a case and each carrying a different duration and process. Understanding which order applies when matters just as much for someone seeking safety as it does for someone responding to a request filed against them.
Emergency Protective Orders Move Fastest
An Emergency Protective Order is the first line of protection, issued directly by a police officer at the scene of a domestic violence call after contacting an on-call judge, often in the middle of the night. It typically lasts only a few days, just long enough to give the protected person time to go to family court and request a longer order. A San Bernardino domestic violence restraining order lawyer often gets involved at this exact moment, since the short window before an EPO expires does not leave much time to plan the next step.
Temporary Restraining Orders Bridge The Gap
Once someone files a formal request in family court using the appropriate Judicial Council forms, a judge can issue a Temporary Restraining Order the same day, based only on the requesting party’s written declaration. A TRO generally lasts until a scheduled court hearing, typically held about three weeks later, and can include no-contact terms, stay-away distances, and temporary custody or residence arrangements in the meantime.
What A Court Actually Reviews At The Hearing
Both sides get a real opportunity to be heard once the case reaches its scheduled hearing date.
- Written declarations and any supporting evidence from both parties
- Testimony from the parties themselves and any witnesses
- Police reports, medical records, or messages relevant to the alleged abuse
- Whether the relationship between the parties actually qualifies for this type of order
The Long-Term Order Carries The Most Weight
If the judge finds that abuse occurred, a full Domestic Violence Restraining Order can be issued following the hearing. Under California Family Code Section 6345, this order can last up to five years and may later be renewed for another five years, or made permanent, without the protected person having to show any further abuse occurred since the original order was granted.
Why This Hearing Deserves Real Preparation
The stakes at a long-term restraining order hearing extend well beyond the order itself, since the outcome can shape custody, housing, and firearm rights for years afterward. Schank Family Law regularly represents both protected parties seeking this longer-term order and restrained parties contesting one, and preparation before the hearing date tends to matter more than anything said in the courtroom that day.
The Consequences Extend Beyond A Stay-Away Order
A restraining order in California carries collateral effects that surprise many people the first time they encounter one. A restrained person is generally barred from owning or possessing firearms and must relinquish any they have, can be required to move out of a shared home even if they legally own it, and may see the order factor directly into a pending custody case, since California law creates a presumption against awarding custody to a parent found to have committed domestic violence.
Responding To An Order Filed Against You
Being served with a TRO does not mean the case is already decided. A San Bernardino domestic violence restraining order lawyer can help a restrained party prepare a response, gather evidence, and present testimony at the hearing, since the outcome at that stage can shape custody, housing, and firearm rights for years afterward.

I cannot thank Schank Family Law and my attorney, Vanessa Estrada, enough for everything they did for me and my daughter. After a long and difficult custody battle, we achieved a successful outcome, and I truly believe Vanessa’s dedication, knowledge, and hard work played a major role in that victory. From day one, Vanessa genuinely cared about my case. She took the time to understand every detail, remembered every situation, and always made me feel like my case mattered. Her professionalism, preparation, and knowledge of family law gave me confidence throughout one of the most stressful times of my life. What impressed me most was how hard she fought. She never gave up, stayed focused on what was in my child’s best interest, and stood by me every step of the way. Whenever I had questions or concerns, she was responsive, honest, and always prepared. If you’re looking for an attorney who truly cares about her clients, is extremely knowledgeable, and will fight for you until the very end, I highly recommend Vanessa Estrada and Schank Family Law.
