Unpaid Child Support Can Cost Your Passport

If you owe child support and hold a U.S. passport, pay attention. The U.S. State Department has announced it will begin revoking passports for parents who owe significant amounts of unpaid support. This is not a distant policy proposal. It is already underway.
Revocations began in early May 2026, starting with parents who owe $100,000 or more. That currently applies to roughly 2,700 passport holders nationally. The program is set to expand soon to cover any parent owing more than $2,500, a threshold established by a federal statute that had largely gone unenforced at this scale.
The Associated Press first reported on the expansion of this program, which is being carried out in coordination between the State Department and the Department of Health and Human Services. You can read the full AP report here.
How the New Policy Works
Until recently, passport enforcement only applied when a parent tried to renew their passport. The new policy changes that entirely. HHS will now proactively flag all past-due accounts to the State Department, which means your current passport can be revoked without you ever submitting an application.
Here is a quick breakdown of where the enforcement thresholds currently stand:
- Current threshold: $100,000 or more in arrears, affecting roughly 2,700 individuals
- Upcoming threshold: $2,500 or more, which could affect many thousands more
- Enforcement basis: A 1996 federal law requiring HHS to report delinquent accounts to the State Department
If your passport is revoked, you will receive official notice and will no longer be able to use the document for international travel. If you happen to be outside the country at the time, you will need to visit a U.S. embassy or consulate to obtain an emergency travel document just to return home.
What This Means for California Parents
California actively reports child support arrears to federal agencies. State agencies track payment histories and share that data directly with HHS. If you are behind on payments in California, your case is not invisible to federal authorities.
As a Monterey child support lawyer, what we see most often is that parents fall behind not out of bad faith, but because their circumstances changed and they never returned to court to modify their order. Income reductions, job loss, and shifts in custody arrangements are all common factors. The legal system has a process for addressing each of them, but that process requires you to take action.
Your Support Order Can Be Modified
If your financial situation has changed since your order was issued, you may have grounds to request a modification. California courts consider a substantial change in circumstances when evaluating these requests. Common reasons include a significant drop in income, a job loss, or a meaningful change in the custody or visitation arrangement.
The important thing is not to wait. Arrears accumulate while you delay, and the consequences now extend well beyond wage garnishment and credit reporting. Schank Family Law works with California parents on all aspects of child support, from establishing initial orders to modifying existing ones and addressing arrears disputes.
Don’t Wait Until It Affects Your Travel
Passport revocation carries real consequences. For parents who travel for work, it can mean direct disruption to your career and livelihood. For those with family abroad, it limits your ability to visit them. And once revoked, having your passport restored requires state-level confirmation that your arrears are fully resolved, which takes time you may not have.
A Monterey child support lawyer can review your current order, help you understand what options may be available, and work with you on a realistic path forward. If you are behind on child support obligations in California, contact Schank Family Law today. Taking action now gives you far more options than waiting for an enforcement letter to arrive.
